The Telephone Consumer Protection Act (TCPA) is a federal law that addresses the growing number of telephone calls from marketers, creditors, and even debt collectors.
Under the TCPA, telemarketing calls, unsolicited faxes, prerecorded calls and autodialed messages to cell phones—and sometimes even landline telephones—are prohibited without the phone subscriber’s permission.

A robocall is a phone call that is made using an autodialer to deliver a pre-recorded message. A phone call made by a live person using an autodialing system is also considered a robocall. If a robocall fails to meet the following requirements, it is considered illegal under the TCPA:
Telemarketers must receive consumers’ written consent prior to the robocall.
Telemarketers must provide an option for recipients of the robocall to opt-out of the calls.
Telemarketers must always state his or her name and the company they work for at the beginning of each robocall.
